  2. Recently it seems alot of people has been airing their frustrations here....I would like to pen down my thoughts on this....as well as seek the wise advice of all the wise people here.... When one door closes on you, sometimes another unexpectedly opens up...for example as you guys know yesterday was the official brokeup date for me...there is nothing tying me and my exgf together anyway as the sale of our property is completed...previously we felt that we were obligated to be together partly because of our joint assets...so with nutti to tie us together....it's perhaps the start of a new beginning for me....the only question I have is that should I cancel the insurance policy we bought on each other for a large sum of money...we had not spoken to each other for months and since we do not contact each other anymore I suppose we will never get back together? With the property issue settled, I feel like asking her so how are you happy? I want to tell her that the small sum of money I deposited in our account is hers and if we should cancel the insurance but I also cannot bring myself to call her. I am both sad and happy at the same time, I realise that there are actually alot of nice girls around for example Rviolet who is really keeping me busy now...so as mentioned when one door closes on you, unexpectedly another opens up.....so I wish all the bros here who has divorce or broken up to keep the faith and be happy....open up your mind and try new things....for example I sturbornly use a nokia phone for 10 years thinking it is the best but after changing to an iphone, wow, it is actually so much better than the symbian software.... He and his wife are now divorced. But except that there is nothing wrong with their marriage and they are still living together. The sole purpose of getting the divorce is to be able to buy ANOTHER HDB FLAT (under the singles scheme). So they collectively own two HDB flats as two single individuals. You see, he was a manager that had recently been displaced by cheaper foreign labour. As all of us know, at our age, there is a real challenge in getting a job that would pay him a decent salary. Yes, there are lots of employers that wants to hire him. He is, afterall, a qualified professional with a wealth of 30 years’ experience behind him. However, these greedy employers are just not willing to pay him his worth and wants to exploit his skills and experience for a mean salary. He refused to prostitute his skills for a low salary. He end up driving a cab that (ironically) pays him more than any of the offers that he had received. He won’t be getting any of his CPF money next year because he won’t be able to meet his minimum sum. All his past CPF contributions (more than $800K) had already gone into his 5rm HDB flat that they are staying in now. His wife has some CPF left but she (too) won’t be able to get a single cent out in a few years’ time because she (too) won’t be able to meet the minimum sum as well. So they planned, got a divorce and bought a second HDB flat just before they could lock away her CPF as the minimum sum in her CPF. They then moved into the new flat and rented their older flat out legally because he had already and duly met the “Minimum Occupation Period” required for the legal renting out for that flat. And this rental income will serve an additional passive retirement income. When I asked if he would be flouting any HDB regulations by doing that, he replied, 1) They are legally divorced and they are both legally SINGLE now. 2) He can retain the existing 5rm flat under the singles scheme and his wife is eligible to buy another flat under the singles scheme. 3) There is no law in this land that prohibit two single persons (divorced or not) from living together as a couple regardless if they were previously married or not. 4) At his age, being legally married is just a marital status. It doesn’t stop them living together as man and wife. They both had made their wills. 5) Instead of having the money stuck as a minimum sum in their CPF, they might as well utilise whatever that they can get out of their CPF so as to get an alternative passive income since:- – – a) they won’t be able to get any of their CPF money anyway – – b) even when they do get their CPF monthly payouts after the age of 65 yrs old (which is still a long way to go), the amounts will be so miserable that they would hardly be able to do anything decent with it anyway… – – c) so…. they might as well get a second HDB flat with whatever money that they can siphoned out from their CPF (before the money is being locked away instead under the minimum sum)…. rent it out and (at least), the monthly rental income of $2,500 can help them live a more dignified retirement IMMEDIATELY (right away) rather than waiting till they reach 65 yrs old for that miserable delayed CPF payout that is so insignificant…. Thinking aloud now…. could this be the new norm of retirement in Singapore that Singaporeans will be planning for? Wouldn’t it be so sad that we have to come to this, in order that we can respond to how our hard-earned CPF money is being wilfully and forcefully withheld from us…

He claims he cannot withdraw his CPF money by next year because it does not meet the Minimum Sum, or Retirement Sum, which is the minimum amount of money needed in your CPF account when you turn 55 before withdrawals can be made. The wife too will not be able to withdraw any CPF money in a few years’ time, since she also does not meet the minimum sum. The plan Husband and wife then divorced. On paper. But they are obviously still very much together. This frees up the wife to buy a HDB flat of her own as a single under the Single Singapore Citizen (SSC) scheme. She is able to get a housing grant for the flat as a second-timer single Singapore citizen applicant. She can pay for it with her CPF — which otherwise would be locked in once she turns 55. The man now owns the first flat as a single. Rental income Since he has lived in the house for longer than the five-year Minimum Occupation Period, he is able to rent it out. The husband then proceeds to live with his now ex-wife in the new flat, while both enjoy the passive income from the rental of the first matrimonial flat — said to be about $2,500 monthly.

These can include: - Maintenance of property, - Groceries, - Domestic help, - Personal grooming - Shopping, - Holidays - Meals For tai-tais, their big-ticket items could be - First class air tickets costing $20,000 and more - Holidays that can include trips to Europe, - Stays in luxury hotels - Regular shopping sprees at high-end boutiques that can come up to $5,000 or more each month - Rental and loan payments on their homes - Beauty treatments such as manicures and pedicures - Visits to hair salons, all of which can cost up to $3,000 - Fine dining at restaurants every month which may set them back about $3,000 - Monthly maintenance covers the ex-wife's personal spending and is separate from maintenance of the couple's children from the marriage. It also does not cover insurance and maintenance parents. The following information has been sourced from You & The Law 3: Division of Matrimonial Assets The Court can order a division of assets or a sale of assets and divide the proceeds which it thinks is just and equitable upon a divorce Matrimonial assets should be acquired during the marrige, and is used or enjoyed by both parties or one or more children. It can also refer to assets acquired before the marriage but substantially improved by one or both spouses. Among other things, the Court can also transfer the assets from one spouse to the other, postpone the transfer or sale of the asset until the youngest child reaches independence, grant one spouse the right to live in a matrimonial home to the exclusion of the other, and order one party to pay the other. Applying for an injunction If a spouse disposes of properties with the intention of reducing his or her means to pay maintenance, or to deprive the other party of his/her right to the properties, the aggrieved party may apply for a Court injunction to prevent the disposal from taking place or to set aside the disposal within three years that the disposal was made. The application for an injunction can be made when any matrimonial proceedings are pending, an order is made for the matrimonial assets to be divided, a maintenance order for the wife or child has been granted, and when maintenance is payable.

Chai also told the court last Thursday that she had ordered a padded toilet seat for her husband as he had backache from spending hours reading and working while sitting on the toilet daily. The Daily Mail reported that Chai’s lawyer Richard Todd QC said last Friday she lived on a “beautiful English estate”, had a taste for English TV shows and valued what was “quintessentially” English. It had been reported earlier that Chai had her 15-room Hertfordshire home decked out in Laura Ashley furnishings because she “loved England and everything English”, and not just because her husband owns a 40% stake in the clothing and interiors firm. Chai filed for divorce in February last year, citing her husband’s unreasonable behaviour. She has accused him of being “very controlling”, rationing her food and forbidding her from leaving their house without his permission. Chai said on Friday that she was not divorcing her husband for money, but to get away from a “violent” relationship, admitting that at one point she had locked herself in a back room, according to The Telegraph. “I just wanted to get away from an abusive, oppressive relationship which I could not take because of my age,” she said. “When I was younger, I could recover.   19. my cousin just got married abt 3 years back and got a son one year after ... but earlier this year, i learnt from my aunt that the wife has sought to divorce him as she claim that he is not putting time and effort into the marriage. anyway, question is : my cousin bought a 3 room HDB under the singles scheme - paid all by himself b4 getting married. now that his wife is seeking a divorce, will he be forced to sell HIS flat ? will he need to split the proceeds from the sale with this wife ? my cousin is a freelancer ...so come on lah ... the girl shud have understood this when they were dating ... where got time to sit there at home and sayang sayang everyday ?? his income also not regular and not doing very well ... and if he really has to sell his self-paid flat and give half of the proceeds to the wife then this is really no sky-law (tian1 li3) !! btw, both are SINGAPOREAN (before someone starts to blame "FTs" again) and i understand he has to pay something to take care of the kid ... which the wife is filing for custody of. oh yah ... since its the wife asking for divorce, my cousin still need to pay alimony to the wife ? sorry lah ... me not a WOMAN ... so dunno the WOMEN'S CHARTER.
  20. my mum and my dad are not on talking terms since my 5 yr old kid was born. my mum is staying with me while my dad is staying with my brother. my mum wants to divorce my dad. my dad is agreeable.   22. Not sure if any of you bros can give any advice on this. -Can a father of 1.5 year old baby, brings her back to his home country Malaysia which both are citizens. Before any divorce proceedings are filed? -The mother is not a Malaysian citizen -Basically the father just want to be the baby as most likely the custody given to the mother. -Is it a Singapore or Malaysia jurisdiction then? -Since the mother is not Malaysian, then custody will be given to the father instead?
